Introduction

When a customer enters the website of Munchies Restaurant, operating under its own name or any affiliated, controlled, or jointly controlled company of Munchies, located at Munchies-restaurant.com, and before completing a transaction to order food and beverages, the customer is required to carefully read the following terms. These terms constitute the legally binding agreement governing any transaction made through the website. Contracts made via this site or through the restaurant’s employees and representatives are subject to the terms outlined in this agreement.

Every user of the site (hereinafter referred to as “User” or “Customer”) acknowledges that they have read and understood the site’s terms of use, privacy policy (accessible via the link provided below), and the general terms detailed in this document. The User and anyone acting on their behalf waives any claims against the restaurant, including its owners, employees, and representatives, except for claims explicitly addressed by the restaurant and specified in this agreement.

Conditions for Site Interaction

Any individual, entity, or legal person with legal capacity can perform actions on the site, provided the following cumulative conditions are met: The user performing actions on the site has the legal capacity to undertake all obligations arising from their actions on this site. The user making payment on the site does so lawfully, using a valid credit card issued to them by an authorized credit company, or with explicit authorization from the cardholder, or using a PayPal account or any other payment method provided by the restaurant. The user making an order on the site and choosing to pay in cash will be solely responsible for paying the cash to the delivery person (for delivery orders) or to the restaurant (for pickup orders). A user of the site must register to receive services. During registration, the user is required to provide identification details such as full name, phone number, email address, and choose a password.

5. The Munchies Restaurant website serves solely as a platform for linking the user with the restaurant, enabling orders to be placed using various payment methods. The restaurant bears full and exclusive responsibility for all representations and information on the site. This includes all aspects related to the restaurant, its accessibility, food quality, descriptions of dishes as vegetarian, vegan, or gluten-free, pricing (including delivery charges), the identity of the delivery company, delivery times, delivery fees, packaging (including eco-friendly utensils), and the actual tip payment to the delivery person. The restaurant is also responsible for the accuracy of the information on the site.
   
   Intellectual Property Rights and Trade Secrets

4. All property rights and intellectual property rights related to the site and any information contained therein are the exclusive property of Munchies Restaurant. No person shall have any right, claim, or demand against Munchies Restaurant regarding these rights.
5. Commercial Names and Trademarks: The commercial names and trademarks associated with them (“Logos”), including the name of the restaurant (Munchies Restaurant), the delivery website, and any subsidiary company name, slogan, promotion, media in the form of pictures or videos, or any marketing campaign, are owned by Munchies Restaurant. No one shall have any right to use these names or claim any rights whatsoever in these names and contents.
6. Copyrights and Intellectual Property: All copyrights and intellectual property rights on the website, including the services offered and all the content included and aggregated therein, are the exclusive rights of Munchies Restaurant or third parties such as subsidiary companies that have received permission from the site owners and Munchies Restaurant for personal or commercial use. It is prohibited to copy, distribute, publicly display, perform publicly, broadcast, make available to the public, modify, process, create derivative works, sell, or rent any part of the aforementioned, whether by the user or through or with the involvement of a third party, in any way or means, whether electronic, mechanical, optical, photographic, recording, or otherwise, without prior written consent of Munchies Restaurant or other rights holders, as applicable and subject to the terms of the agreement (if provided). No permission is granted to use any name, sign, or symbol (“Logo”) identical or similar in a misleading manner to the trademarks, logos, or names of Munchies Restaurant or its subsidiaries. Actions or omissions that may in any way affect the integrity of Munchies Restaurant must be avoided. If consent is granted as stated above, any action to remove, delete, or disrupt any notice or sign regarding intellectual property rights, such as copyright © or trademark ® symbols, accompanying the content’s use, must be avoided. Advertisers’ trademarks and advertisements on the site constitute their property alone and cannot be used without the explicit written consent of the advertiser in advance.
7. Munchies Restaurant respects the copyrights of others. If any person or entity finds information, an image, or any other representation on the site that they believe infringes the copyrights of any person or company, they should contact us by email, specifying its content and location. Accordingly, the Munchies Restaurant team will act promptly to remove it.

5. The customer and any other party are permitted to use the website’s content for personal and non-commercial purposes only, subject to these terms. The site may not be used otherwise unless explicit prior consent has been obtained from Munchies Restaurant in writing and subject to the terms of the agreement (if provided).
6. The responsibility for using the website and any consequences arising from it lies solely with the user.
7. Permission to use the site’s services is granted for lawful purposes only.

10. Content from the site shall not be displayed within a frame, mirrored, or performed in-line linking to any part of the site.
11. Content from the site shall not be displayed in any way, including through any software, device, accessory, or communication protocol, which alters their design on the site or removes any content, especially advertisements and commercial content.
12. Links to the site from any site containing pornographic content, content encouraging racism or derogatory defamation, or content contrary to law, or whose publication is contrary to the law or encourages activity contrary to the law, shall not be established.
13. Links to content from the site that is not the homepage (“deep linking”) shall not be established, and content shall not be displayed or published in any other way.
14. Munchies Restaurant and/or the site operators are entitled to cancel any deep link at their sole discretion. In this case, the deep link must be canceled immediately, and the user shall have no claim, demand, or lawsuit against Munchies Restaurant, the site owners, its operators, subsidiary companies, or anyone acting on their behalf in this matter.
15. It is prohibited to bypass means used by the company to prevent or restrict access to the website. You may not copy, modify, adapt, transmit, distribute, translate, display, perform reverse engineering, or separate any part of the content or website and present it to the public, create derivative works, perform, distribute, sublicense, commercially exploit, sell, transfer, process, collect, or integrate with other software any material subject to the intellectual property rights of Munchies Restaurant in any way or by any means.
16. Do not interfere with or disrupt the operation of the website, servers, or networks hosting the website. Do not perform any action that creates or may create an unreasonable or excessive load on the website infrastructure.
    
    Additional Terms

6. Prices displayed on the website include VAT, unless otherwise explicitly stated.
7. Regarding the minimum order, delivery fees, if any, will not be included in the minimum amount.
8. If any events occur that are beyond Munchies Restaurant’s control or if there are disruptions in computers, phone systems, or communication systems during the purchase process, Munchies Restaurant or its authorized representative may cancel the purchase (in whole or in part). In such a case, Munchies Restaurant will refund any amount paid or, alternatively, cancel the credit card charge or other payment method for the transaction. In the event of a printing error, a typographical error, or a discrepancy in the product description, price, delivery dates, or any other information, Munchies Restaurant or its representative may cancel the specific purchase and void the charge for the transaction.
9. A future order can be canceled without charge immediately after it is placed and no later than 24 hours before the requested delivery time. An order canceled less than 24 hours before the requested delivery time will be charged in full. Any change or cancellation of an order must be coordinated with Munchies Restaurant via phone, email, or any communication method available directly to Munchies Restaurant’s team.
10. Munchies Restaurant reserves the right to cancel a purchase made on the website at its discretion and subject to the law if the user enters false or partial details.
11. Munchies Restaurant is not responsible and does not guarantee that the website will operate and/or be available at all times without interruption or flaw. Munchies Restaurant is not responsible for the inability of the website to operate or be accessible for any reason whatsoever, including internet interruptions or network issues, technical problems, or other issues not within Munchies Restaurant’s control (including but not limited to hacking, force majeure, third-party negligence, etc.). If such a problem is identified by the user, it is their obligation to report it to Munchies Restaurant, and we will do our best to address the issue promptly.
    
    Jurisdiction

1. The above terms, their interpretation, and enforcement are subject to the law. Any actions taken through this website are subject to legal proceedings, and any matters arising from a legal action performed on this website will be clarified in the competent court.

Munchies Restaurant reserves the right, at any time, to permanently block and/or restrict the user’s access to the website and/or to block, cancel, and/or limit access to the account and/or prevent the user from performing actions on the site, in whole or in part, at its sole discretion. This includes, among other reasons, actions taken by the user intentionally in connection with the website and/or the violation of these terms by the user, in addition to any other remedy available to Munchies Restaurant under any law.
3. Munchies Restaurant also reserves the right, at any time and at its sole discretion, to temporarily or permanently discontinue the website without prior notice and to restrict access to the site for maintenance and improvement of the services provided therein. The user agrees and acknowledges that Munchies Restaurant shall not be responsible for any loss of information and/or damages arising from or related to its decision to discontinue or suspend the website.
4. Munchies Restaurant reserves the right to change or transfer its obligations and/or rights under these terms without limitation and without notice to or the need for the consent of the user or any other third party.
